In April 2024, the investment and trade treaty came into force, guaranteeing the possibility of an E-2 visa for Portuguese citizens (including, for example, Brazilians with Portuguese citizenship). The U.S. E-2 visa is an opportunity for Portuguese investors to establish a business or acquire an existing company in the U.S. or for Portuguese companies to transfer executive, managerial, or essential employees to their U.S. operations. It is a non-immigrant visa that allows Portuguese nationals and their family members to temporarily reside in the US, provided that the investment meets specific criteria established by the US government.

The applicant must have Portuguese citizenship. This means that Portuguese nationals and Brazilians with dual citizenship can apply for an E-2 visa using their Portuguese nationality. To apply for an E-2 visa, an investor must demonstrate that they are investing a “substantial” amount of capital in a venture in the USA. There is no set minimum, but the amount invested must be significant enough to guarantee the success and sustainability of the business. The investment requirements will depend on the nature of the business activities; naturally, businesses that require more equipment or inventory will require a larger investment than a business that involves providing services or consulting, for example.
Dependents of Portuguese E-2 visa holders, including spouses and children under the age of 21, can also obtain authorization to reside in the United States for the duration of the visa and the spouse will receive authorization to work in the United States, while the children will be able to attend American schools and universities.
It’s worth noting that even though Brazil doesn’t have a treaty granting the E-2 visa, the American consulate in São Paulo still accepts applications for the E-2 visa, making it possible for Brazilians with dual Portuguese citizenship in Brazil to apply.
The E-2 visa is initially granted for a period of up to five years, with the possibility of continuous renewal, as long as the investment and business continue to meet the established requirements, such as profitability, for example.
